- Murder is the unlawful killing of another person with intent, which can be expressed or implied. In Florida, DUI means driving with a blood alcohol content (BAC) of .08 or higher or while your normal faculties are impaired. You can also be charged with DUI even if your BAC is lower than the legal limit based on police observations about your conduct or appearance (e.g. slurred speech, red eyes).
Also, the state has an “implied consent law.” Under this law, anyone issued a driver’s license agrees to submit to a chemical test of their BAC (e.g. breathalyzer) if stopped by police for suspicion of DUI. If you refuse to submit to testing, your license may be automatically suspended.
