Assault & Battery

There are several classifications of assault and battery ranging from simple assault to aggravated battery which can be charged as misdemeanors or felonies depending on factors such as the extent of the victim’s injuries and whether the defendant acted with intent. Under Florida law, assault and battery are two distinct offenses:

  • Assault involves an intentional, unlawful threat by word or an act to do violence to another person
  • Battery occurs when a person intentionally touches, strikes, or causes bodily harm to another person
Homicide/ Murder

  • Manslaughter is defined as the killing of another person without lawful justification and the premeditation required for murder. It can be further categorized as either voluntary or involuntary, where voluntary involves killing in the heat of passion, and involuntary involves unintentional killing due to negligence or recklessness.
  • Murder is the unlawful killing of another person with intent, which can be expressed or implied. It is categorized into different degrees, with first-degree murder involving premeditated intent to kill, and second-degree murder involving a depraved disregard for human life but without premeditation.
DUI Defense

In Florida, DUI means driving with a blood alcohol content (BAC) of .08 or higher or while your normal faculties are impaired. You can also be charged with DUI even if your BAC is lower than the legal limit based on police observations about your conduct or appearance (e.g. slurred speech, red eyes).

Also, the state has an “implied consent law.” Under this law, anyone issued a driver’s license agrees to submit to a chemical test of their BAC (e.g. breathalyzer) if stopped by police for suspicion of DUI. If you refuse to submit to testing, your license may be automatically suspended.
